(Reuters) – A U.S. appeals court on Thursday rejected Texas Democrats’ bid to allow all state residents to vote by mail due to the coronavirus pandemic, ruling that the state’s law extending that right only to those over 65 was not unconstitutional age discrimination.
A split three-judge panel of the 5th U.S. Circuit Court of Appeals vacated a lower court’s preliminary ruling that had required the state to expand mail-in voting to all eligible voters.
The Texas case is just one of dozens of court challenges across the country over whether to expand voting rights in light of the pandemic. President Donald Trump, a Republican, has asserted without evidence that voting by mail will result in fraud, although many states have used the practice for decades with no major problems.
Texas law allows voters over age 65, as well as those with certain disabilities, who are ill, absent from their home counties or confined to jail, to vote by mail. In a separate case, the state’s high court ruled in May that the risk of contracting the novel coronavirus was not in itself a valid reason to allow mail-in ballots.
The 5th Circuit’s majority said the state’s law did not violate the U.S. Constitution’s prohibition on age discrimination because it merely conferred an extra benefit on older residents, rather than limiting the right to vote for younger Texans.

Appeals Court Rules Against Judicial Expansion of Mail-In Voting

Good.
Man of many words tonight, Kevin.
If mail-in voting is truly directly connected to voter fraud, does that mean we can’t trust the results from overseas military members who constantly vote by mail?
Asking for a friend…
Mar,
Have to keep it simple for my liberal friends. Complex thoughts, like asking them to openly support specific cops being attacked by disgusting liberal mob, is too much for them.
Actually, Penquin, I’m not sure about fraud, but there have been many instances where military votes have not been counted by local officials.
https://cronkitenews.azpbs.org/2016/08/24/reports-to-the-federal-government-about-military-voting-often-are-flawed/
Mar,
Your story from 2016 didn’t say military votes weren’t counted.
“When Americans vote for president in November, many of the 1.4 million active-duty U.S. military personnel stationed or deployed overseas will not know whether their absentee ballots have reached their home states to be counted. And the federal Election Assistance Commission, charged with monitoring their votes, may not know either.”
Ok, then try this: https://www.fvap.gov/info/reports-surveys/StateoftheMilitaryVoter
And why were the ballots not cast or counted?
If you read the article you would see why.
But….. the trump family, and many members of the current administration vote by mail.
I read it. Looks like a lot of ballots were sent in late, not received on time, and many service members chose not to send in the ballot they requested.
Sounds like service members would like to vote electronically or receive and return ballots via email.
LeeeeeeeeeeeeeeRoy, who claims to hold a local-Gummint position, still doesn’t know the difference between “mail-in” voting which is the fraud-method preferred by Democrats, and “absentee” voting.
Ask your local clerk. It’s not real hard to do, is it? After all, you’re an official, no longer just a clerk-typist for the forest rangers or state patrol….
Penguin… https://www.heritage.org/voterfraud
Someone will have to grab a juice box and sit down with Foust… its a database. Contrary to popular Liberal lies, voter fraud does happen.
Wrong on all counts again, dud.
Le ROI lies again.
And this is why you are not respected by most people here.
So mar, what are you talking about? You are being incoherent again.
Talking about absentee voting vs universal mail in voting where everyone has to vote by mail.
You don’t know the difference and then lie about it.
Sorry to burst your bubble , but I do know the difference, and the similarities, and how it works. By the looks of your comments you don’t.
Now go sweep the forest floor.
I live in the desert moron.
And if you knew the difference, you wouldn’t complain about the way Peesident Trump, family members and administration vote.
Unless of course, it is out of hatred of your President Trump.
Either way, you are lying.
What the data The Heritage Foundation shows is that the if you attempt to commit voter fraud you will be caught. Appears the system works.
It looks like the liberals on this board don’t know the difference between vote by mail where ballots are mailed to all registered voters, and absentee voting where each voter has to request a ballot and provide an address to send it.
We received letters for the two previous owners of our home In the recent mailing to all WI registered voters by the WI elections commission. Why are those names and addresses still on the list, and What would happen to those ballots in an election?
The right to vote also means the right to abstain from voting. Voting in person or by absentee ballot respects that choice as well.
Hey Pat, prove that statement please.
>data The Heritage Foundation shows is that the if you attempt to commit voter fraud you will be caught.
Thats like posting Murder conviction stats and saying “see every murderer is caught”. Thats a pretty stupid thing to say based on conviction stats.
I’m merely posted what I did because people here have said in the recent past “Voter fraud doesn’t happen”. It does and more than that… anyone who thinks that what I posted shows all of it is not an honest person.
Hey Jason, prove that statement wrong.
mar:
Name calling in response, eh mar? No acknowledgement you and yours ? got owned
I don’t get it. Trump wants people to mail in their ballots and then go to the polls to check if they’ve been counted. Why would someone vote by mail and then go to the polling place. Just go to the polling place and vote if you have to go through all that???
When the Russians release their compromat tape, that typo will be hilarious.
>Hey Jason, prove that statement wrong.
Good come back Pat. Exactly what I expect from you and your ilk.
I learned that from you, Jason. You have to be proud I learned so well from you.
Prove it Pat.
What, that I used your tactic? I would have thought that was self evident.
There are AT LEAST 240,000 invalid voter-addresses kept by the Wisconsin Elections Commission. They were ordered to delete them, refused, appealed, and the case sits in SCOWI undecided.
You expected otherwise?
