Judge Reverses Demotion of Milwaukee Police Chief

Good.

MILWAUKEE — MILWAUKEE — A judge has reversed the Fire and Police Commission’s decision to demote former Milwaukee Police Chief Alfonso Morales.

Milwaukee County Circuit Court Judge Christopher Foley said the decision of the Milwaukee Fire and Police Commission to demote Morales from police chief to captain was not proper.

In a seven page ruling, Milwaukee County Judge Christopher Foley condemns the Milwaukee Fire and Police Commission. Foley writes the Commission failed to follow basic requirements for ousting the city’s top cop, writing in part, “It is clear this entire process was flawed.”

    I know nothing about Alfonso Morales and I have not been following the MPD news. Irrespective of that, this is not a promising development for democracy.

    A civilian oversight committee selected by a democratically elected mayor and approved by a democratically elected common council decides that they guy in charge of leading the men with guns should not be in charge of leading the men with guns. Then a single judge decides he will make the decision who will lead the men with guns.

    This is not a good sign for our society. We should have democratic oversight and civilian command over our police and military forces.

    Maxwell, if you bothered to read the article, the PFC did not follow their own rules.

    MaxwellsEQs This is why we are a democratic republic. The Chief wasn’t elected, he was appointed to a four year term by another appointed commission. Twice removed from a democratic result. The elected representatives also decreed that the chief would have a four year term once appointed to limit political interference with his office.

    The commission ignored all of that and ignored due process rules and contract law (enacted by your elected representatives and upheld by the courts). This is actually a very good result for our system of government.

    The Commission was run by a very corrupt lawyer when they fired Morales.  That lawyer remains on the commission.  Morales let it be known that the lawyer was seriously compromised–ethically–in a police investigation, and that lawyer’s been after Morales ever since.

    Look for a VERY fat money settlement.

    Meantime, Tommy Barrett, Doddering Mayor, is hoping that the lawyer won’t make the front page again until Barrett retires.

    Heh.
